1.Scope
These General Terms and Conditions (GTC) govern the contractual relationship between EN FORME GmbH, based in Zurich, Switzerland, and customers participating in training sessions, courses, or other services.
By booking or participating in a training session, the customer acknowledges these GTC as binding.
2.Disclaimer and Health Responsibility
2.1 Participation at Own Risk
- Training is carried out at the customer's own risk and responsibility.
- EN FORME GmbH and the trainers accept no liability for accidents, injuries, or health damages that occur during or after training.
2.2 Customer’s Health Condition
- By registering, the customer confirms that they are healthy and physically capable of participating in the training.
- Illnesses, injuries, or other health limitations must be reported in writing to the studio or trainers before the start of the course.
- If the customer is under medical treatment, they must provide a written consent form from their treating physician before starting training.
2.3 Use of Equipment and Mat
- The use of all Pilates machines, mats, and other equipment is at the customer’s own risk.
- Customers must strictly follow the instructions of the trainers. Liability is excluded in the case of improper use or failure to comply with safety regulations.
2.4 Training on Medical Prescription
- Training based on a medical prescription and billing through the customer’s health insurance is only possible with appropriately qualified trainers and must be clarified and confirmed in advance.
2.5 Insurance
- It is the customer’s responsibility to take out accident or liability insurance.
- EN FORME GmbH and PILATESwiss Studio are not liable for consequential damages, lost profits, or any other indirect damages.
3.Liability for Personal Belongings
- EN FORME GmbH and PILATESwiss GmbH where the training take place accept no liability for the loss, theft, or damage of personal belongings (including valuables, mobile phones, clothing, etc.).
- Customers are responsible for securing their personal belongings.
4.Booking, Cancellation, and Refunds
4.1 Booking
- Booking of courses, private training sessions, or subscriptions is done online, via email, or directly at the studio.
- Registration is binding, and the course fee must be paid in advance.
4.2 Cancellation by the Customer
- Cancellations must be made at least 24 hours before the start of the session. Otherwise, the session will be fully charged.
- Subscriptions are non-refundable and have a fixed validity period.
4.3 Cancellation by EN FORME GmbH
- EN FORME GmbH reserves the right to cancel courses due to illness, unforeseen events, or insufficient participant numbers.
- In such cases, the customer will be offered a replacement appointment or credit. Cash refunds are excluded.
5.Subscriptions and Validity
- Subscriptions (e.g., 10-session cards) have a fixed validity period (e.g., 3 or 6 months) and are non-transferable.
- Extensions are only possible in cases of medically confirmed illness or accident, where the interruption lasts at least 7 consecutive days, for the duration of the illness/convalescence, but for a maximum of 6 months.
- Refunds of the purchase price are excluded.
- Unused training sessions in a subscription cannot be refunded.
6.Code of Conduct and Studio Rules
- Customers must behave respectfully and comply with the safety and hygiene rules of the studio.
- EN FORME GmbH reserves the right to exclude customers from training in cases of repeated violations of the rules or inappropriate behaviour.
7.Force Majeure & Business Disruptions
- EN FORME GmbH is not liable for business interruptions caused by force majeure (e.g., natural disasters, pandemics, government orders, strikes, etc.).
- No entitlement to a refund of course fees exists in such cases.
8.Change of Studio Location
- If EN FORME GmbH changes the training place to another studio within the city of Zurich, no right to refunds or special termination applies.
9.Data Protection
- All personal data is handled confidentially in accordance with Swiss data protection regulations (DSG) and will not be shared with third parties.
- Customers agree to the storage of their data for course management and billing purposes.
10.Jurisdiction and Applicable Law
- The exclusive place of jurisdiction is the City of Zurich, Switzerland.. Swiss law applies.
